Pregnant Workers Fairness Act (PWFA) ensures pregnant workers are provided reasonable accommodations related to lactation, which includes, but is not limited to: breaks; pumping; a space for lactation that is not the restroom/bathroom (which includes a space close to the workers regular work area that is fully functional, cleaned regularly, access to a sink, running water, and refrigeration); the possibility of arrangements for nursing during the employees work hours when the child is in close proximity; and the temporary suspension of one or more essential functions of the employees position if the employee has a known limitation under PWFA and is unable to perform the essential function with or without reasonable accommodations.
Discrimination on the basis of pregnancy is prohibited, and this includes childbirth or related medical conditions, such as lactation. Note in certain circumstances, a pregnancy-related medical condition may also be a disability.
Nutrition service requirements: A program must design and implement nutrition services that are culturally and developmentally appropriate, meet the nutritional needs of and accommodate the feeding requirements of each child. In addition, a program must promote breastfeeding, including providing facilities to properly store and handle breast milk and make accommodations, as necessary, for mothers who wish to breastfeed during program hours, and if necessary, provide referrals to lactation consultants or counselors.
Breastfeeding on Federal Property: Did you know women may breastfeed their child at any location in a federal building or on federal property? As long as the woman and her child are otherwise authorized to be present at the location, they are allowed to breastfeed according to public law.
